1. 在越南的「夫妻共同財產」之定義
根據 TDH 法律事務所(未註年份)指出,依據婚姻與家庭法(Luật hôn nhân gia đình)之規定,夫妻婚後所取得之土地使用權屬於夫妻共同財產。
而妻子或丈夫於婚前取得、或屬個人單獨繼承之土地使用權,僅在夫妻雙方另有特別協議時,方得列為共同財產。
👉 夫妻共同財產屬於「合一共有(共同共有)」性質。

2. 財產若當時僅登記在丈夫或妻子其中一方名下之情況...
若屬夫妻共同財產之資產,於本法令(指該施行細則)生效日前已辦理所有權登記,且當時僅登記在丈夫或妻子其中一方名下,夫妻得向國家主管機關申請重新核發該資產之所有權登記證書,以補登夫妻雙方之姓名;若夫妻未申請重新核發所有權登記證書,該資產在法理上仍屬於夫妻共同財產;倘若發生爭議,主張該資產屬個人特有(單獨)財產之任一方,負有舉證責任(依據修正前《婚姻與家庭法》施行細則,即第 70/CP 號政令第 5 條第 3 款之規定)。
3. 夫妻於台灣(或國外)辦理結婚登記,但未在越南辦理登記結婚呢?
若夫妻雙方未在越南辦理結婚登記,但已於國外完成登記,則根據第 69/2006/NĐ-CP 號政令(該政令旨在修改關於涉外婚姻與家庭關係之第 68/2002/NĐ-CP 號政令)第 1 條第 7 款之規定:您在國外進行的結婚登記只要完全符合該外國法律之規定,其婚姻關係在越南將獲得法律承認(特殊國家除外)。屆時,您的婚姻在越南領土上即具備合法效力。
第 69/2006/NĐ-CP 號政令第 1 條第 7 款,將原第 20 條修改如下:
「第 20 條:承認在國外進行之結婚登記
- 越南公民之間、或越南公民與外國人之間,在國外主管機關辦理之結婚登記,若符合該國法律規定,且在結婚當時,該越南公民並未違反越南法律關於結婚條件之規定者,在越南獲得法律承認。……」

1. Identification and Recognition of Property Acquired During Marriage
(If purchased during the marriage and without a separate property agreement, this property remains the joint property of the couple in terms of legal value).
According to TDH Law Firm (n.d.), pursuant to the provisions of the Law on Marriage and Family (HNGĐ), land-use rights acquired by a husband and wife after marriage are considered the common property of the couple. Land-use rights obtained by either the wife or the husband prior to marriage, or acquired through separate inheritance, shall only be treated as common property if there is an explicit agreement between the spouses. The common property of the husband and wife constitutes integrated joint ownership (indivisible common ownership).
In cases where a property belongs to the common ownership of the husband and wife and was registered prior to the effective date of this Decree, but only lists the name of either the husband or the wife, the couple may request the competent state agency to reissue the ownership registration certificate to include the names of both spouses. If the couple does not request the reissuance of the ownership certificate, the asset shall legally remain the common property of the husband and wife. In the event of a dispute, whichever party claims the asset as their separate/individual property shall bear the burden of proof (Clause 3, Article 5 of Decree No. 70/CP, guiding the implementation of the Law on Marriage and Family).
2. Marriages Registered in Abroad, but Not Registered in Vietnam
If a couple does not register their marriage in Vietnam but has registered it in a foreign country, according to Clause 7, Article 1 of Decree No. 69/2006/NĐ-CP (which amends Decree No. 68/2002/NĐ-CP regarding marriage and family with foreign elements), your marriage conducted abroad will be legally recognized in Vietnam as long as it fully complies with the laws of that foreign country(Except for certain specially designated countries). Consequently, your marriage will be valid and legal on the territory of Vietnam.
Clause 7, Article 1 of Decree No. 69/2006/NĐ-CP amends Article 20 as follows:
"Article 20. Recognition of marriages conducted abroad
- A marriage between Vietnamese citizens, or between a Vietnamese citizen and a foreigner, that has been registered with a competent authority abroad in accordance with the laws of that country, shall be recognized in Vietnam, provided that at the time of the marriage, the Vietnamese citizen did not violate the provisions of Vietnamese law concerning marriage conditions. ..."
