1. 越南2026年起正式處罰電子煙及加熱式菸品使用行為

越南政府發布 第90/2026/NĐ-CP號法令，對醫療衛生領域行政違規處罰作出新規定。其中，第26條正式明定電子煙及加熱式菸品相關違規行為之裁罰標準。

依據新規定，自2026年起，使用電子煙及加熱式菸品者將依法處以行政罰鍰，對於容留他人在其所有或管理場所內使用電子煙或加熱式菸品者，亦將依法追究行政責任。

2. 使用電子煙或加熱式菸品　最高可罰500萬越盾

依據第90/2026/NĐ-CP號法令第26條規定，使用電子煙或加熱式菸品者，可處300萬至500萬越盾罰款。

除罰鍰外，違規使用之電子煙及加熱式菸品亦將依法強制銷毀。

3. 容留他人使用　最高可罰1,000萬越盾

若個人在自己所有或管理之場所內，容留他人使用電子煙或加熱式菸品，可處500萬至1,000萬越盾罰款。

不過，法令亦規定例外情形。

若容留者與違規使用者具有下列親屬關係，則不適用上述裁罰規定：祖父母，父母，子女，孫子女，親兄弟姊妹，配偶

4. 企業及場所管理者應提高法規遵循意識

新規定不僅針對使用者，也對場所管理責任提出更明確要求。

對於企業、餐飲場所、娛樂場所及其他公共場所管理者而言，應加強場所管理，避免發生容留他人使用電子煙或加熱式菸品之情形，以降低違反行政法規之風險。

第90/2026/NĐ-CP號法令正式建立電子煙及加熱式菸品相關行政裁罰制度。除使用者可能面臨罰鍰及物品銷毀外，場所管理者若容留他人違規使用，亦可能依法負擔行政責任。企業應檢視內部管理制度及公共場所管理措施，避免因容留違規使用行為而承擔行政處罰風險。

Vietnam Imposes Fines on E-cigarette Use: Up to VND 5 Million for Users, VND 10 Million for Allowing Use

1. Vietnam to Fine E-cigarette and Heated Tobacco Use from 2026

Vietnam has issued Decree No. 90/2026/NĐ-CP, introducing new administrative penalties in the healthcare sector. Article 26 specifically establishes penalties for the use of e-cigarettes and heated tobacco products.

From 2026, individuals using these products may be subject to administrative fines. Those allowing others to use them on premises under their ownership or management may also be held legally responsible.

2. Using E-cigarettes May Result in Fines of Up to VND 5 Million

Under Article 26, individuals using e-cigarettes or heated tobacco products may be fined between VND 3 million and VND 5 million.

In addition to the monetary penalty, the violating products will be confiscated and destroyed in accordance with the regulations.

3. Allowing Others to Use Them May Lead to Fines of Up to VND 10 Million

Individuals who allow others to use e-cigarettes or heated tobacco products on premises under their ownership or management may be fined between VND 5 million and VND 10 million.

However, this provision does not apply where the person allowing the use is the violator's grandparent, parent, child, grandchild, sibling, or spouse.

4. Businesses and Property Managers Should Strengthen Compliance

The new regulation expands responsibility beyond users by imposing obligations on property owners and managers.

Businesses, restaurants, entertainment venues, and other public facilities should strengthen internal management measures to prevent violations and reduce legal risks.

Decree No. 90/2026/NĐ-CP establishes a clear administrative penalty framework for e-cigarette and heated tobacco violations. Understanding these requirements will help individuals and businesses improve legal compliance and minimize regulatory risks.
